    2. December 2003 Graduates:

      RESOLVED THAT the Faculty Senate of the University of Wisconsin-Whitewater recommends to the University of Wisconsin System Board of Regents that the University of Wisconsin-Whitewater students who have applied for graduation in December 2004 and who have been certified by the University Registrar to have met all academic requirements and completed all of their courses of study be granted their degrees at the December 2004 commencement exercises.

    3. Resolution on UW Trust Fund holdings:

      WHEREAS there have been allegations that some of the world’s governments, including, for example, the Israeli government, have been and continue to be engaged in grave human rights violations, including engaging in military assaults on civilians, making mass arrests, holding and torturing political prisoners, willfully destroying agricultural land, displacing civilian refugees, depriving civilians of water and food, demolishing homes, confiscating land, hostage-taking and conducting extra-judicial assassinations; and,

      WHEREAS the International Court of Justice has ruled that Israel’s Security Wall violates international humanitarian law as well as the fundamental human rights of the Palestinians; and,

      WHEREAS it is alleged that these acts constitute war crimes, and, in some cases crimes against humanity, proscribed by such international codes and agreements as the Principles of the Nuremberg Charter and Judgment, The United Nations Declaration of Human Rights, United Nations Security Council and General Assembly resolutions, the International Covenant of Civil and Political Rights, the Geneva Conventions (in particular, but not limited to the 4th Geneva Convention), the Convention Against Torture, the Convention on the Rights of the Child, Protocol 1; and,

      WHEREAS, the U.S. Foreign Assistance Act of 1961, 22 USC sec. 2304, provides that “no security assistance may be provided to any country the government of which engages in a consistent pattern of gross violations of internationally recognized human rights”; and,

      WHEREAS, University of Wisconsin System Regent Trust and Fund Policy 78-1 provides that “In accordance with Sec. 36.29(1) Wis. Stats., all investments ‘made in any company, corporation, subsidiary or affiliate which practices or condones through its actions discrimination on the basis of race religion, color, creed or sex. . . .’ shall be divested in as prudent but rapid a manner as possible”; and,

      WHEREAS, University of Wisconsin System Regent Trust and Fund Policy 97-1 (Investment and Social Responsibility) provides that “the Board acknowledges the importance of maintaining an awareness of public concerns about corporate policies or practices that are discriminatory (as defined by 36.29(1) Wis. Stats.) or cause substantial social injury, and it will take this factor into account.”

      BE IT RESOLVED that the Faculty Senate of the University of Wisconsin-Whitewater calls upon the University of Wisconsin System Board of Regents to conduct a disinterested and expert investigation into the allegations stated above toward the possible end of divesting of holdings in Boeing, Caterpillar, General Dynamics, Lockheed Martin, Northrop Grumman, Raytheon and any companies demonstrated to be knowingly supplying weaponry or financial support for any nations which engage in such human rights violations.
