RESOLUTIONS OF THE 2001/2002 FACULTY SENATE

FS0102-1 In its September 11, 2001 meeting under agenda item 4.b.i. the 2001/2002 Faculty Senate appointed a task force to act on the Chancellor's request for faculty to report on what areas of faculty development need additional support or are considered to be more important than other areas. The task force is to solicit information from all faculty and report to the Senate at the November 13 meeting. Senators from the College of Arts and Communication were unable at the time to identify a representative. The remaining membership is:

FS0102-2 In its September 11, 2001 meeting under agenda item 5.a. the 2001/2002 Faculty Senate approved revisions to Faculty Personnel Rules governing recruitment and hiring, Faculty Handbook, Section VI-F, III, A, B, E, F, G, and H. In its September 11, 2001 meeting under agenda item 5.c. the 2001/2002 Faculty Senate passed the following resolution.

Resolved that the University of Wisconsin-Whitewater Faculty Senate requests that the Senate and General Assembly of the State of Wisconsin enact legislation to allow faculty and academic staff of the University of Wisconsin System the right to vote for or against collective bargaining. Approved.

In its November 13, 2001 meeting under agenda item 4.b. the 2001/2002 Faculty Senate passed the following resolution.

Resolved that the Faculty Senate requests that the Faculty Salary Committee discover and report at or before the February 12, 2002 Faculty Senate Meeting on the following matters affecting 2001 market, equity, and compression adjustments (see http://acadaff.uww.edu/Salary/SalaryPlan2001-03.htm ):

  1. by what process(es) decisions were made as to whether to award market, equity, and compression adjustments and in what amounts;
  2. the criteria used in determining adjustments;
  3. the relative weighting (if any) of market, equity, and compression used in determining adjustments;
  4. what due process was afforded to applicants in determining adjustments;
  5. the names of all applicants for such adjustments upon whose applications Chancellor Miller acted and the amount of the applicants' awards, including all instances of no amount awarded;
  6. the percentage actually used of the one-third of the pay plan allotted for market, equity, and compression adjustments.

In its November 13, 2001 meeting under agenda item 4.c. the 2001/2002 Faculty Senate passed the following resolution.

Resolved that point two of the Textbook Rental policy (see http://www.uww.edu/uwwhdbk/0055J.htm ) be revised to read: "A request for a new text may be submitted as a new book order: a) when a new edition of an existing text becomes available; or b) when the existing text goes out of print."

By action taken under agenda item 4.b.i of its December 11, 2001 meeting, the Faculty Senate passed the following resolution on December, 2001 graduates:

The Faculty Senate of the University of Wisconsin-Whitewater recommends to the University of Wisconsin System Board of Regents that the University of Wisconsin-Whitewater students who have applied for graduation in December 2001 and who have been certified by the University Registrar to have met all academic requirements and completed all of their courses of study be granted their degrees at the December 2001 commencement exercises.

By action taken under agenda item 4.b.ii of its December 11, 2001 meeting, the Faculty Senate passed the following resolution on the Regents' use of Safransky v. The Personnel Board, 62 Wis. 2d 464 (1974):

Because the Board of Regents of the University of Wisconsin System has adopted the Safransky decision (Safransky v. The Personnel Board, 62 Wis. 2d 464 [1974]) as the standard of “just cause,” which standard permits the dismissal of a faculty member at a University of Wisconsin institution if "some deficiency has been demonstrated which can reasonably be said to have a tendency to impair his [sic] performance of the duties of his [sic] position or the efficiency of the group with which he [sic] works”;

And because, in the Marder case, this inappropriate standard was applied to no adequate findings of fact;

And because this standard is inapplicable in the specific situation of faculty members at a University of Wisconsin institution, with the distinctive rights and imperatives of academic freedom and shared governance and all that such entail;

The University of Wisconsin–Whitewater Faculty Senate strenuously objects to the Board of Regents’ adoption of the Safransky decision as the standard of “just cause” and calls upon the Board of Regents to restore due process protections of tenure and to return to the principle of “just cause” as it is traditionally understood in the context of academic institutions; and

The Faculty Senate further calls upon the Board of Regents in making their decisions to comply fully with procedural and substantive provisions of the UWS Administrative Code and state statutes; and

The Faculty Senate further directs that copies of this resolution be forwarded to the Regents of the University of Wisconsin System, the President of the University of Wisconsin System, the Office of the Governor of the State of Wisconsin, the members of the Senate and Assembly of the State of Wisconsin, and the office of the Attorney General.

By actions taken under agenda item 6. c. of its February 5, 2002 meeting, the Faculty Senate approved the following resolution concerning the function and structure of the new Advising Center our campus will see next Fall.

Resolved that: Whereas the concerns enumerated above [in "Resolution TO: Faculty Senate FROM: Daryle Waechter-Brulla and Meg Waraczynski, on behalf of and with the approval of the Master Advisors of the College of Letters and Sciences"; attached] are sufficient to warrant extreme caution in instituting the new advising center as it is currently proposed in the Center Plan, be it resolved that the Faculty Senate urges Chancellor Miller, Provost Prior, Asst. Chancellor Barbara Jones and WSG to cooperate with the Advising Council in developing the advising plan, and to bring the final plan to the senate before the plan is instituted.

By actions taken under agenda item 4. c. of its March 12, 2002 meeting, the Faculty Senate approved the following resolution recommending to you the attached Report of the Task Force on Faculty Development Funds Distribution.

Resolved that the Faculty Senate recommends to Chancellor Miller the report of the Task Force on Faculty Development Funds and that the Senate commends Chair Wentz and the Task Force members for conscientiously gathering, carefully analyzing, and clearly presenting their findings.

FS0102-21 In its March 12, 2002 meeting, under agenda item 4.d., the 2001/2002 Faculty Senate passed the following resolution regarding Senate representation on the Advising Council: Resolved that the Faculty Senate recommends to Chancellor Miller that one Faculty Senator be elected to represent the Faculty Senate as a regular member of the Advising Council, and that immediately upon adopting this resolution, the Senate elect one Faculty Senator to be recommended to Chancellor Miller. Upon passing the resolution, the Senate chose Colette Dollarhide to serve as this Senate representative to the Advising Council.

Resolved that Dr. Dianne Jones serve as the Faculty Senate's elected faculty member to the Equal Opportunity Committee pending the most immediate opportunity to conduct an odd-year election as specified in the Equal Opportunity Committee by-laws. By actions taken under agenda item 6. d. of itsApril 9, 2002 meeting, the Faculty Senate unanimously approved the following resolution regarding qualifications of the Faculty Athletic Representative for Women:

Resolved that the Faculty Senate expresses its support for the Intercollegiate Athletics Committee Motion of February 15, 2002 that "the Faculty Athletic Representative for Women meet the guidelines set forth by the NCAA. The committee has preference that [the] Representative has faculty status, which is implied in the title."

Under agenda item 4.b. of its May 7, 2002 meeting, the Faculty Senate heard from Dr. Jim Molloy the report of ad hoc committee on UWW free speech policy. Upon hearing and discussing the policy, the Senate passed the following resolution:

The UW-Whitewater Faculty Senate approves the proposed policy on “Assemblies, Rallies, Parades, Pickets and Demonstrations” with the recommendations that:

1) the committee restore language throughout the document referring to “the building supervisor or police services” to the language of UWS 18 and 21, with added parenthetical references indicating who serves as the authorized official(s); and that

2) insofar as practicable, the committee specify procedures and expeditious time limits on the Office of Leadership Development's processing of off-campus groups' requests.

The Senate further instructs that the Senate Chair forward the Senate's recommendations to the committee.
