Who can file a complaint about a student's behavior?

Anyone can file a complaint that a student's behavior has violated UWS Chapter 17. Complaints typically come from other students, faculty or staff members, police officers, or members of the Whitewater community. Complaints may also be made about a UW-Whitewater student's behavior on another UW System campus or, in some cases, outside of the campus setting.

How can a person file a complaint about a student's behavior?

A complaint about a student's behavior may be filed with the Assistant Dean of Student Life, UC 253, 262-472-1533. Typically, such a complaint should be a detailed written report outlining the behavior that is alleged to violate a provision of UWS 17. A complainant may make a verbal complaint and, depending upon the nature of the complaint, may be asked to put it in writing.

What happens when a complaint is filed?

All complaints about student behavior will be investigated by the Assistant Dean of Student Life or a member of the university staff. IN all cases, the accused student will be notified of the complaint and investigation, and will be invited to provide input. The first step is to discuss the matter with the conduct officer. If the student chooses not to take advantage of this opportunity, the matter will proceed without the benefit of their input. An investigation of the alleged incident will be conducted, which could include interviews with the complainant(s), witnesses, victims, police officers, and others who can provide pertinent information. It may also include reviews of documents and/or other evidence related to the allegation of misconduct. At the conclusion of the investigation, a decision will be made regarding the disposition of the case. Any student who is held responsible for a violation will have the right to request a hearing in the matter. What are the possible penalties for violation provisions of UWS 17?

As stated in UWS 17.04, sanctions may range from a reprimand to expulsion. Other possibilities include probation, restitution, community service work, restriction of privileges, or the requirement of education experiences. In all cases, the student conduct officer will work to find the most appropriate response to the violation.

How does sexual assault fit in the code of conduct?

According to the UW System Code, sudents may be disciplined for "17.03(1) Conduct which constitutes a serious danger to the personal safety of a member of the university community or guest." (As futher defined in the code, this includes serious crimes against the person, such as sexual assault).

Anyone who wishes to report a sexual assault is welcome to be accompanied by another person during any meetings or conversations related to the report.
