Disability Services Appeals Policy and Process

Denied an Approved CSD Accommodation?

IF YOU ARE CURRENTLY RECEIVING SERVICES FROM THE CENTER FOR STUDENTS WITH DISABILITY (CSD) AND HAVE DENIED AN APPROVED CSD ACCOMMODATION IN THE CLASSROOM, HOUSING, OR OTHER UNIVERSITY PROGRAM:

Level 1 Informal

  1. If the University, a department, program or faculty is not willing to provide an approved CSD accommodation, contact your Disability Services Coordinator immediately. It is UW-W's policy that a CSD approved accommodation is implemented during an appeal process.
  2. At no time during an appeal process shall a student be harassed or have a negative consequence as a result of filing an appeal.
  3. CSD may recommend that you first have a discussion with the individual or instructional staff regarding the issue.
  4. CSD staff will meet with you and the faculty/instructional member or other UW-W staff to problem solve and mediate a resolution.

Level 2 Formal

If the issue is not resolved between the student and the individual denying the approved CSD accommodation, then the student can file a written appeal with the Director of CSD, or their designee.

  1. The written appeal must be filed within fifteen (15) business days after receipt of the individual denying the approved CSD accommodation to the Director of CSD, or their designee.
  2. At no time during an appeal process shall a student be harassed or have a negative consequence as a result of filing an appeal.
  3. During the appeal process the approved CSD accommodation will be implemented until a final decision is made.
  4. The appellate review will be based on the information and materials in the case file, the Disability Service Coordinator findings and recommendations and rational provided by the individual denying the approved CSD accommodation.
  5. The Director of CSD (or designee) may affirm, modify or reverse the decision of an individual denying the approved CSD accommodation, or at their discretion, refer the matter to the Department Chair, Department Dean, appropriate Director of Services, or ADA Coordinator (or their designees). The Director of CSD (or designee) shall notify the student and individual denying the approved CSD accommodation in writing of their decision or referral within fifteen (15) business days after the appeal is received.

 

Denied a Requested Accommodation or Service by CSD?

IF YOU ARE A STUDENT WHO HAS BEEN DENIED A REQUESTED AUXILIARY AID, SERVICE, ACCOMMODATION, OR DISABILITY DETERMINATION BY YOUR DISABILITY SERVICES COORDINATOR (DSC): 

Level 1 Informal

  1. Following the denial, the student can provde additional documentation, evidence, and/or support to their DSC for review. The DSC will review the additional materials and inform the student of their decision within fifteen (15) business days.
  2. At no time during an appeal process shall a student be harassed or have a negative consequence as a result of filing an appeal.
  3. Within five (5) business days after receipt of the decision of the DSC, the student may submit a written request for review by the Director of CSD or their designee.
  4. The Director or designee shall notify the student in writing of their decision within fifteen (15) business days after the appeal is received. The Director/designee may affirm, modify, or reverse the decision of the DSC.

Level 2 Formal

  1. Within fifteen (15) business days after receipt of the decision of CSD, the student may request in writing appellate review by the ADA Coordinator or their designee. The request to the ADA Coordinator/designee shall be in writing, and shall include a brief statement of the grounds for appeal. The grounds for appeal shall be that:
    • There was substantial failure by the Director of CSD/designee to comply with these procedures so as to deny a fair review of the request, or
    • The decision of the Director of CSD/designee was not supported by the evidence.
  2. At no time during an appeal process shall a student be harassed or have a negative consequence as a result of filing an appeal.
  3. The appellate review will be based on the information and materials in the case file, the Director of CSD's findings and recommendations and the student's written request for appellate review.
  4. The ADA Coordinator may affirm, modify or reverse the decision of the Director of CSD, or at his or her discretion, refer the matter to the Director of CSD for further review and decision. The ADA Coordinator shall notify the student in writing of their decision within fifteen (15) business days after the appeal is received. The decision of the ADA Coordinator shall be final and not subject to further review.
